Bharatiya Sakshya Adhiniyam (BSA), 2023 Bharatiya Nyaya Sanhita (BNS), 2023 Code of Criminal Procedure and other applicable regulations

2. Acceptance of Terms Accessing our website, portals, or platforms, Booking any consultation or service,

Making any payment to Cyber Privilege, or Submitting any data, device, or information to us,

You unconditionally agree to be bound by these Terms & Conditions, Legal Disclaimer, and Policies.

If you do not agree, you must not use our services.

3. Scope of Services

All services are provided on a professional best-effort basis using accepted forensic, cybersecurity, and investigative methodologies.

Cyber Privilege is not a law enforcement agency, court, or judicial authority.

Our opinions, reports, findings, and advisory outputs are technical/professional opinions, not judicial decisions.

Any legal outcome depends on courts, investigating agencies, and competent authorities.

4. No Guarantee of Outcome

Cyber Privilege does not guarantee:

Case results, convictions, recoveries, or legal success

Detection of all threats, malware, or intrusions

Recovery of lost, deleted, or destroyed data

Acceptance of any report or opinion by any court or authority

Digital forensics and cybersecurity involve technical, legal, and situational uncertainties. Results depend on:

Data availability and integrity

Device condition and history

Third-party systems and logs

Timeliness of incident reporting

Legal and procedural factors beyond our control

5. Client Responsibilities

The client agrees that:

All information, devices, accounts, and data provided are lawfully owned or lawfully authorized for examination.

No illegal, unauthorized, or malicious request will be made to Cyber Privilege.

The client is solely responsible for legal permissions, consents, and court orders where required.

The client will not misuse Cyber Privilege reports, opinions, or communications for unlawful, defamatory, or malicious purposes.

Cyber Privilege reserves the right to refuse or terminate any engagement that appears unlawful, unethical, or non-compliant with applicable law.

6. Fees, Payments & Commercial Terms

All fees are advance / milestone based / as agreed in writing.

Unless explicitly stated in writing:

Fees are non-refundable

Fees are non-adjustable

Fees are non-transferable

For consultations (including phone):

Time is strictly limited to the booked duration

No extension is guaranteed

No refund for missed, unused, or partially used sessions

Late payments:

May attract interest/penalty as mentioned in invoice or agreement

Cyber Privilege may suspend services until dues are cleared

Taxes (GST or others) are extra as applicable unless stated otherwise.

7. No Refund Policy

All payments made to Cyber Privilege are strictly non-refundable, including but not limited to:

Consultation fees

Investigation fees

Retainer fees

Analysis or reporting charges

Training or certification guidance fees

Once resources, time, expertise, or infrastructure are allocated, no refund or reversal will be entertained under any circumstances.

8. Confidentiality & Data Protection

Cyber Privilege follows strict confidentiality and data handling protocols.

Client data is handled in accordance with:

DPDP Act, 2023

Applicable IT laws

Reasonable security practices and procedures

However, the client acknowledges:

Absolute security cannot be guaranteed in any digital system

Cyber Privilege is not liable for breaches caused by factors beyond reasonable control (e.g., force majeure, third-party platforms, client-side compromise, court/lawful seizure, etc.)

Data may be disclosed:

When required by law, court order, or lawful authority

For compliance, audit, or legal defense purposes

With client consent where applicable

9. Legal Disclaimer (Very Important)

Cyber Privilege is not a court, not a police authority, and not a judicial body.

Our reports, opinions, and certifications are technical and professional in nature.

Final interpretation, admissibility, and reliance are solely at the discretion of courts and competent authorities.

Nothing provided by Cyber Privilege should be construed as:

Legal advice (unless explicitly stated in writing by a qualified legal professional)

A guarantee of legal outcome

A substitute for police investigation or judicial process

10. Limitation of Liability

To the maximum extent permitted by law:

Cyber Privilege shall not be liable for:

Indirect, incidental, consequential, or special damages

Loss of business, reputation, data, profits, or opportunity

Actions taken by the client or third parties based on our reports or advice

Any legal, financial, or operational consequences arising from use or misuse of our services

Our total liability, if any, shall never exceed the amount actually paid by the client for the specific service in question.

11. Intellectual Property

All reports, formats, frameworks, methodologies, templates, tools, and documentation created by Cyber Privilege remain our intellectual property, unless otherwise agreed in writing.

The client may use the deliverables only for the stated purpose.

Reproduction, redistribution, or commercial reuse without written permission is strictly prohibited.

12. Compliance with Law

The client agrees that:

All use of Cyber Privilege services shall comply with:

IT Act, DPDP Act 2023, BNS 2023, BSA 2023

Other applicable Indian and international laws

Any illegal request (hacking, spying, unauthorized surveillance, data theft, impersonation, etc.) will be immediately refused and may be reported to authorities.

13. Termination of Services

Cyber Privilege reserves the right to:

Suspend or terminate services without notice if:

The client violates any law or these terms

The engagement is found to be unlawful or unethical

Payments are not made as agreed

There is misuse of reports, name, or brand

In such cases, no refund shall be applicable.

14. Jurisdiction & Governing Law

These terms shall be governed by the laws of India.

Any dispute shall be subject to the exclusive jurisdiction of competent courts in India (as per Cyber Privilege’s registered/operational jurisdiction).

15. Policy Updates
