5. Client Responsibilities
The client agrees that:
All information, devices, accounts, and data provided are lawfully owned or lawfully authorized for examination.
No illegal, unauthorized, or malicious request will be made to Cyber Privilege.
The client is solely responsible for legal permissions, consents, and court orders where required.
The client will not misuse Cyber Privilege reports, opinions, or communications for unlawful, defamatory, or malicious purposes.
Cyber Privilege reserves the right to refuse or terminate any engagement that appears unlawful, unethical, or non-compliant with applicable law.
6. Fees, Payments & Commercial Terms
All fees are advance / milestone based / as agreed in writing.
Unless explicitly stated in writing:
Fees are non-refundable
Fees are non-adjustable
Fees are non-transferable
For consultations (including phone):
Time is strictly limited to the booked duration
No extension is guaranteed
No refund for missed, unused, or partially used sessions
Late payments:
May attract interest/penalty as mentioned in invoice or agreement
Cyber Privilege may suspend services until dues are cleared
Taxes (GST or others) are extra as applicable unless stated otherwise.
7. No Refund Policy
All payments made to Cyber Privilege are strictly non-refundable, including but not limited to:

Retainer fees
Analysis or reporting charges

Once resources, time, expertise, or infrastructure are allocated, no refund or reversal will be entertained under any circumstances.
8. Confidentiality & Data Protection

Applicable IT laws
Reasonable security practices and procedures
However, the client acknowledges:
Absolute security cannot be guaranteed in any digital system
Cyber Privilege is not liable for breaches caused by factors beyond reasonable control (e.g., force majeure, third-party platforms, client-side compromise, court/lawful seizure, etc.)
Data may be disclosed:
When required by law, court order, or lawful authority
For compliance, audit, or legal defense purposes
With client consent where applicable

IT Act, DPDP Act 2023, BNS 2023, BSA 2023
Other applicable Indian and international laws
Any illegal request (hacking, spying, unauthorized surveillance, data theft, impersonation, etc.) will be immediately refused and may be reported to authorities.
13. Termination of Services
Cyber Privilege reserves the right to:
Suspend or terminate services without notice if:
The client violates any law or these terms
The engagement is found to be unlawful or unethical
Payments are not made as agreed
There is misuse of reports, name, or brand
In such cases, no refund shall be applicable.
14. Jurisdiction & Governing Law
These terms shall be governed by the laws of India.
Any dispute shall be subject to the exclusive jurisdiction of competent courts in India (as per Cyber Privilegeβs registered/operational jurisdiction).
