By accessing our website, communicating with us via email or digital platforms, or engaging in services with Cyber Privilege, you expressly acknowledge and agree to the following terms and conditions of this Legal Disclaimer.

1. Without Prejudice Clause

This communication, including all clarifications, advisory notes, reports, and cost structures, is issued strictly without prejudice. Nothing stated herein shall be deemed:

• A waiver of rights by Cyber Privilege;

• An admission of liability;

• A binding contract or enforceable agreement.

A service engagement becomes legally binding only upon execution of a duly signed and authorized Service Agreement, under the seal and authority of Cyber Privilege.

All professional services and communications are subject to:

• Cyber Privilege Policies & Code of Conduct

• Privacy Policy (covering data collection, storage, and retention)

• Terms & Conditions (binding on all engagements)

• Annexure I to Annexure 38, which collectively govern:

  • Client communication protocols

  • Confidentiality obligations

  • Cyber ethics compliance

  • Remote work security standards

  • Reporting and escalation procedures

These annexures form an integral part of Cyber Privilege’s operational and legal ecosystem.

3. Client Responsibility & Liability

Cyber forensic services inherently involve sensitive data, legal complexities, and law enforcement interfaces. Clients acknowledge and accept that:

• All legal, financial, and evidentiary liabilities arising from escalations, litigation, or law enforcement proceedings rest solely with the client.

• Cyber Privilege provides advisory, technical, and forensic analysis services without assuming liability for client actions, legal interpretations, or misuse of reports.

• Any reliance on Cyber Privilege’s reports or clarifications in judicial or regulatory proceedings is at the client’s own risk, unless explicitly validated under applicable provisions such as Section 65B of the Indian Evidence Act (BSA, 2023).

4. Data Protection & Privacy Compliance

Cyber Privilege ensures full-spectrum compliance with both Indian and international data protection frameworks:

• ✅ GDPR Compliance (EU Standards) – Ensuring lawful, fair, and transparent data processing, along with rights of access, rectification, and erasure.

5. Information Security & Confidentiality

Cyber Privilege enforces a robust Confidentiality, Integrity, and Availability (CIA Triad) architecture, ensuring:

6. Limitation of Liability

Cyber Privilege, its employees, associates, or representatives shall not be held responsible for:

• Misrepresentation, alteration, or misuse of forensic reports by clients.

• Outcomes resulting from judicial, regulatory, or law enforcement interpretations beyond Cyber Privilege’s control.

• Any direct, indirect, incidental, or consequential damages, except as expressly covered in a duly signed agreement.
